Discussing the impact of the decision on patent law, Professor Epstein writes:
Apart from the immediate sigh of relief within the patent world, the next question is what does this development portend for the larger patent scene. Here I read the case as indicating that the era of patent bashing in the Supreme Court may be coming to an end.
Richard Epstein is the James Parker Hall Distinguished Service Professor of Law at the University of Chicago and director of the John M. Olin Program in Law and Economics. Professor Epstein co-authored an amicus curiae brief with Scott Kieff in the Bilski case.
