Policy makers should institute the best available technology standard in regard to screening copyrighted material on webhosting platforms. This new standard would increase innovation in automatic filtering, limit litigation, and give webhosting companies incentives for policing their own content.

Partial patents, both “Semi” and “Quasi,” present a real and feasible method for reforming the patent system. They present an intermediate form of patent protection that could help fix the patent system at low societal cost.

Various methods have been put forth to save the doctrine of fair use as it relates to use of copyrighted works. However, this approach has several advantages over those already proposed.

The law provides explicit property rights to some kinds of information but not to others. This leads to some innovation being protected under a property rights model and some innovation being protected by other means that the law still affects. Legal doctrine thus affects organization of innovation.

Firms will continue to collect large numbers of patents, mostly benefitting large organizations at the expense of smaller ones. Some legal changes might help.
